These Terms and Conditions of Sale (hereinafter "T&Cs") govern the contractual relationships between:
These T&Cs define the conditions under which Flash makes available a platform enabling:
Any use of the Platform implies full acceptance of these T&Cs.
Acceptance is evidenced by:
The Client acknowledges having read these T&Cs and accepts them without reservation.
To access Platform services, the user must create an account with accurate and up-to-date information: full name, valid email address, phone number, postal address, and secure password.
A verification email is sent upon registration. The user must confirm their email address to activate their account.
Any Photographer wishing to offer services on the Platform must operate legally and provide the following documents:
Flash reserves the right to refuse, suspend or request regularisation of any account with invalid or fraudulent documents.
The Client selects a Photographer, chooses a package and a time slot, then confirms the booking. The Photographer then proposes a meeting location which the Client accepts or declines. After the session, the Photographer delivers photos via the Platform. The Client selects their photos and validates their selection to download them in high resolution.
Flash offers gift vouchers enabling any person (hereinafter "the Buyer") to offer a photography session to a third party (hereinafter "the Recipient"). Purchasing a gift voucher constitutes acceptance of the following specific conditions:
Prices are freely set by each Photographer. The price shown to the Client is the selling price of the service, invoiced by the Photographer to the Client. It includes the Photographer's rate, which is paid to the Photographer in full, and Flash's commission of 10% of that rate, which Flash deducts from the payment and invoices to the Photographer. Example: For a €100 rate, the Client pays €110. The Photographer invoices the Client €110, Flash invoices the Photographer a €10 commission, and the Photographer receives €100.
Flash operates a pay-at-booking model: the Client pays at the time of their booking request. Payment is held securely by the Platform and only transferred to the Photographer after the Client validates the delivered photos. Payment to the Photographer is triggered after this validation.
Payment is processed exclusively online via Stripe. Accepted methods: credit/debit card (Visa, Mastercard, American Express) and other Stripe-supported methods.
Payment is transferred to the Photographer after explicit Client validation or expiry of the 7-day claims period. Transfer is made manually within 14 business days.
The Client may purchase additional photos beyond their package. The unit price is set by the Photographer and subject to the same 10% commission.
Flash may offer temporary promotions. Any discount is entirely funded by Flash and does not affect the Photographer's remuneration.
The Platform automatically generates, for each completed service after payment validation: the Photographer's invoice to the Client, at the selling price of the service, and Flash's commission invoice to the Photographer. When a promotional offer was used, the Photographer's invoice mentions the discount funded by Flash and the amount paid by the Client. Invoices are available in the Photographer's personal space and include all legally required information (invoice number, dates, party details, amounts, VAT where applicable).
The Photographer remains solely responsible for the accuracy of their professional information and for retaining documents for the legally required period (minimum 10 years). Flash is not liable for errors resulting from incorrect information provided by the Photographer.
Photographers manage their availability via an online calendar. Only time slots shown as available can be booked. A booking is only confirmed once the Client has accepted the meeting location proposed by the Photographer and both parties have received a confirmation email.
Automatic reminders are sent 24 hours before the session and 24 hours after (delivery reminder to the Photographer).
The Client may cancel their booking more than 48 hours before the session. In this case, Flash will issue a full refund of the amount paid.
If the Client cancels within 48 hours of the session, and only when the booking is fully confirmed (meaning the meeting location has been proposed by the Photographer and accepted by the Client), 50% of the service price is paid to the Photographer as compensation. The service fee (Flash commission) is retained by the Platform. The remaining balance is refunded to the Client.
If the booking is not yet fully confirmed at the time of cancellation (meeting location not yet proposed or not yet accepted by the Client), the Client is fully refunded, regardless of how close the session date is.
If the Photographer cancels at any time, the Client is fully refunded the amount paid. Repeated cancellations may result in sanctions (warning, suspension, exclusion).
In the absence of a formal cancellation, for bookings confirmed within the meaning of Article 7 and subject to Article 8.8, the following rules apply after investigation by Flash:
These situations are subject to a case-by-case review by the Flash team. Supporting evidence must be provided by the relevant party (screenshots, messages, proof of attendance, etc.) before any processing takes place.
A session may be rescheduled at any time by mutual agreement. In the event of an unforeseen circumstance (illness, bad weather, personal or professional constraint...), either party may initiate a rescheduling request directly from the Platform.
No penalty applies in the event of an accepted rescheduling. A rescheduling request does not constitute a cancellation and does not trigger any refund.
In cases of force majeure (weather conditions, illness, etc.), the affected party may request a rescheduling that the other party cannot refuse. Supporting documentation must be sent to social@flashapp.fr to validate the situation. A refund remains possible upon receipt of this documentation.
Refunds are processed within 14 business days to the original payment method.
The meeting location and time slot must be validated using the Platform's features (location proposal and acceptance, alternative time slot proposal, rescheduling request). Where the Client and the Photographer agree on a location or time slot via the Platform's messaging system without validating it on the Platform, and the messages establish the explicit agreement of both parties on the location and time, the following rules apply after investigation by Flash:
Flash bases its review exclusively on the information validated and the messages exchanged on the Platform. Exchanges taking place outside the Platform (phone, text messages, third-party messaging apps, email) are not taken into account. In the absence of an agreement established on the Platform, the booking is deemed unconfirmed and the Client is fully refunded, in accordance with Article 8.2.
If the photos are delivered via the Platform, the service is deemed performed and the usual rules apply (Articles 5.4 and 12.3).
The Photographer undertakes to operate legally with a valid SIRET number, hold professional liability insurance, provide authentic documents, keep their calendar up to date, honour all confirmed bookings, and deliver a professional quality service.
Photos must be delivered within 14 business days in high-resolution digital format, meeting quality standards: sharpness, correct exposure, minimum 3000px on the longest side, correct framing, subject's face visible on 100% of photos.
The Photographer must respond to Client messages within 24 hours via the Platform's messaging system.
If either party fails to take a required action, the Platform sends progressive reminders:
The refund or payment release is processed manually by the Flash team within 14 business days.
The Photographer undertakes not to circumvent the Platform with regard to any Client they were put in contact with through Flash. Circumvention includes, in particular:
The Client is encouraged to use only the Platform to communicate with the Photographer and to book, and to report any circumvention proposal to Flash. Only bookings and payments made on the Platform benefit from the guarantees provided in these T&Cs (secure payment, refunds, mediation).
In the event of a breach of these T&Cs, in particular circumvention of the Platform, Flash may, depending on the seriousness and repetition of the facts, take one of the following measures against the user concerned:
Any measure is notified to the user in writing with a statement of reasons. Except in urgent cases or obvious fraud, the user is first invited to submit their observations. A permanent exclusion takes effect 30 days after notification, unless the breaches are serious or repeated, in which case it may take effect immediately. The user may contest the measure by writing to social@flashapp.fr. Bookings that are already confirmed are either honoured or cancelled with a full refund to the Client.
Flash does not carry out any general or systematic monitoring of conversations. An automatic system detects contact details (phone, email, social media) in messages in order to block them before a booking is confirmed.
Flash may review the content of a specific conversation only in the following cases:
Such a review is limited to the conversation concerned, carried out only by authorised members of the Flash team, and solely for the purposes of handling the dispute or report, preventing fraud and enforcing these T&Cs. The details of this data processing are set out in the Privacy Policy.
Photos are made available for direct download via the Platform. The Client receives an email notification upon delivery. Photos are stored on the Platform for 90 days from delivery; after this period, availability is not guaranteed.
Any complaint regarding the quality or number of photos must be submitted within 7 days of delivery. After this deadline, photos are deemed accepted.
The Photographer retains copyright over all photographs taken. Payment grants the Client a personal, non-commercial licence including the right to share on social media and reproduce for private use. Any commercial use is strictly prohibited without prior written consent from the Photographer.
The Photographer may use the photos for their professional portfolio and communication. The Client may object in writing within 7 days of the session.
Flash acts solely as a technical intermediary and is not responsible for the quality of photographic services, incidents during sessions, or disputes between parties. Flash's liability is limited to the commission received on the disputed transaction.
The Photographer is solely responsible for the quality of their services, their professional liability insurance, legal and tax compliance, and any damages caused to the Client or third parties during the service.
Flash collects data necessary for providing services (identity, contact details, payment). In accordance with the GDPR, users have rights of access, rectification, erasure, restriction, portability and objection. To exercise these rights: social@flashapp.fr.
In the event of a dispute, the parties must first attempt an amicable resolution via the Platform's messaging system. If no agreement is reached, the dispute is reported to Flash. Clients may also refer the matter to a consumer mediator free of charge.
Flash reserves the right to amend these T&Cs at any time. Users are notified by email and Platform notification. Amendments take effect 30 days after notification. Continued use of the Platform after this date constitutes acceptance of the new T&Cs.
These T&Cs are governed by French law. In the event of a dispute, the parties will seek an amicable resolution before initiating any legal proceedings.
